The vertical transportation industry is dynamic and broad-based; companies engaged in the design, manufacture, sale, modernization and maintenance of vertical transportation equipment frequently face claims that initiate or are initiated by products liability litigation, civil and general liability litigation, complex commercial litigation, administrative proceedings, bid disputes, as well as construction litigation and arbitration. The frequency with which individuals, municipalities, condominium associations, mall owners, property management companies and other forms of property owners interact with vertical transportation companies inevitably creates the potential for a wide variety of issues, ranging from personal injuries, wrongful death claims, claims for breach of contract, breach of warranty, indemnification, insurance, construction defects, construction delays, performance and payment bond claims, as well as environmental claims.
The Firm serves as Florida counsel for several of the world’s largest vertical transportation manufacturing, sales and service companies, and has extensive experience representing these companies in various litigation, arbitration, mediation, and administrative proceedings in both State and Federal courts. Our experience includes defending claims for catastrophic personal injuries and property damage arising from allegations of product defects, manufacturing flaws, negligent maintenance, design, installation and modernization, as well as claims for breach of express or implied warranties and construction defect delay claims, relating to geared and gearless traction elevators, hydraulic elevators, freight elevators, escalators, moving walks, hydraulic/motorized gangways, handicapped lifts, dumbwaiters, specialty lifts and materials handling systems. We also have substantial experience in both prosecuting and defending cross-party, third-party and direct claims for contract coverage, breach of contract and for indemnification and insurance arising out of actions for personal injuries, property damage, construction defects and delays, and subcontracted projects. We further have experience in prosecuting and defending construction/mechanics lien foreclosures, liens transferred to security, payment bond claims, performance bond disputes, as well as post-judgment enforcement and asset retrieval.
